By using the Nebraska Department of Motor Vehicles (DMV) AI Resident Assistant (AI Resident Assistant), you as the “End User,” accept and agree to the following terms and conditions.
- End User understands and agrees that End User is using the AI Resident Assistant (and artificial intelligence technology) at End User’s own risk and discretion and understands and agrees that End User is solely responsible for End User’s own decisions and actions based on the information provided by the AI Resident Assistant. By using the AI Resident Assistant, End User acknowledges and agrees that End User is solely responsible for use of the AI Resident Assistant in any manner that is contrary to the uses for which the AI Resident Assistant is designed and offered for use.
- End User shall not create, upload, or share content that violates third-party copyright, trademark, privacy, data protection, publicity, or other rights or that plagiarizes third party content. Additionally, End User shall not: (a) enter text prompts designed to generate copyrighted, trademarked, patented, or otherwise infringing content; (b) upload or share information or images that includes a third party' s copyrighted or trademarked content; (c) modify, make derivative works of, disassemble, reverse compile, reverse engineer, or otherwise use any part of the AI Resident Assistant to discover any underlying components of the models, algorithms, and systems, such as exfiltrating the weights of models; (d) access or use the AI Resident Assistant in order to build or support, and/or assist a third party in building or supporting, products or services competitive to Tyler or its subsidiaries1; (e) license, sell, rent, lease, transfer, assign, distribute, display, host, outsource, disclose, permit timesharing or service bureau use, or otherwise commercially exploit or make the AI Resident Assistant available to any third party other than as expressly permitted by these terms and conditions; (f) provide, store, or transmit infringing, unsolicited marketing emails, libelous, or otherwise objectionable, unlawful or tortious material; (g) interfere with or disrupt the integrity or performance of the services (including without limitation, vulnerability scanning, penetration testing, excessive use, spamming, distribution of malware, use of automated or scripting processes (such as bulk or automated uploading of content), or manual or automated simulations of adversarial actions); (h) use web scraping, web harvesting, or other data extraction methods to extract data; or (i) attempt to gain unauthorized access to the AI Resident Assistant or its related systems or networks.
- End User shall not use AI Resident Assistant in the following manners (a) to generate or interact with content prohibited in these terms and conditions; (b) to present content alongside or to monetize content prohibited in these terms and conditions; (c) to make decisions without appropriate human oversight as part of an application that may have a consequential impact on any individual' s legal position, financial position, life opportunities, employment opportunities, or human rights, or may result in physical or psychological harm to an individual; (d) to deploy subliminal techniques (e.g., visual, auditory, or other signals beyond a normal person' s range of perception) with the intent to deceive or cause harm; (e) to deceive or intentionally misinform, for false advertising, or to manipulate or distort the behavior of a person in a way that causes harm; (f) to exploit any of the vulnerabilities of a person (e.g., age, disability, or socio-economic situation); (g) for social scoring or predictive profiling that would lead to discriminatory, unfair, biased, detrimental, unfavorable, or harmful treatment of any group of people or an individual person; (h) to categorize people based on their biometric data or to infer characteristics or affiliations about them; (i) or unlawful tracking, stalking, or harassment of a person; (j) without the individual' s valid consent, for ongoing surveillance or real-time or near real-time identification or persistent tracking of the individual using any of their personal information, including biometric data; (k) to generate content with the purpose of removing or altering content credentials or other provenance methods, marks, or signals ("AI Content Credentials") that indicate that the content was generated by a AI Resident Assistant; (l) to generate content with the purpose of misleading others about whether the content was generated by AI Resident Assistant; or m) to detect AI Content Credentials with the purpose of removing or altering them.
- End User acknowledges and understands that the AI Resident Assistant is not designed to serve as the system of record and shall not be used in a manner that interrupts services. The AI Resident Assistant may store user queries to improve response quality and support administrative insights. The AI Resident Assistant is not designed to process or store personal information or data protected under the Family Education Rights and Privacy Act (FERPA), data from Criminal Justice Information Services (CJIS), Health Insurance Portability and Accountability Act (HIPAA), Nebraska Uniform Motor Vehicle Records Disclosure Act (UMVRDA), or other sensitive data.
- End User acknowledges and understands that AI Resident Assistant is not designed or intended for use in locations outside of the United States or by children under the age of 13 years old, and that End User is solely responsible for compliance with any laws applicable to users who choose to access AI Resident Assistant, including from non-US locations.
- End User acknowledges that the AI Resident Assistant may at times limit the services' ability to respond to particular topics, such as probing for personal information or seeking opinions on sensitive topics or current events, even if not prohibited by these terms and conditions.
- There is no warranty of the accuracy or reliability of the AI Resident Assistant, and the content generated by the AI Resident Assistant, may not always be correct, up-to-date, or applicable to a specific situation, and may be inappropriate or unexpected. End Users are encouraged to verify information with the originating state agency. The content generated by our AI is not intended as a substitute for professional advice. Additionally, ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES, DUTIES, OR CONDITIONS OF MERCHANTABILITY, TITLE OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. THERE IS NO WARRANTY TO SECURE THE AI RESIDENT ASSISTANT, AND THERE IS NO GUARANTEE THE AI RESIDENT ASSISTANT CANNOT BE COMPROMISED. THE AI RESIDENT ASSISTANT IS PROVIDED "AS IS". END USER UNDERSTANDS THAT THE AI RESIDENT ASSISTANT MAY NOT BE ERROR FREE, AND USE MAY BE INTERRUPTED.
- The State of Nebraska (State or Nebraska) and its affiliates, partners, and employees shall not be held liable for any direct, indirect, incidental, consequential, or any other damages arising out of or in connection with End Users use of the AI Resident Assistant. This includes, but is not limited to, any errors or omissions in the content, loss of data, or business interruption. Nebraska is a sovereign state, and nothing contained in these terms and conditions shall be construed to waive the State’s sovereign immunity.
